Summary of Money Lenders Ordinance & Borrowing Guidelines

Loan Agreements Must Be Executed In Writing
Under Section 18 of the Money Lenders Ordinance, all loan agreements must be made in writing, stating the loan amount, repayment terms, form of guarantee, interest rate and other critical details. Borrowers shall read all loan papers and agreement summaries thoroughly before signing, and only confirm after verifying all information is clear and accurate.

Rights of Borrowers and Guarantors

Early Repayment & Unlawful Clauses
Under Section 21 of the Money Lenders Ordinance, borrowers may fully settle loans early subject to statutory conditions; money lenders shall not arbitrarily impose higher interest rates due to early repayment.
The Ordinance also prohibits compound interest and unreasonable bans on instalment repayments within loan agreements. If an agreement contains unlawful provisions, the court may rule on the enforceability of such clauses or the whole contract depending on circumstances.
Explanation of Excessively High Interest Rates
Under Sections 24 and 25 of the Money Lenders Ordinance, any loan carrying an annual percentage rate above the statutory cap may not be enforceable, and the money lender may face prosecution. Even if the rate does not exceed the legal maximum, the court may revise agreement terms if it deems the interest rate or clauses grossly unfair.
